These Terms of Service (these “Terms”) govern your access to and use of the websites, applications, digital products, events, online education, ticketing, merchandise stores, communities, content, subscriptions, and other products and services made available by Behindthechair.com, Inc. (“BTC,” “BehindTheChair,” “we,” “us” or “our”).
For purposes of these Terms, the “Services” include, without limitation, https://behindthechair.com, https://www.btcuniversity.com, https://theshow.behindthechair.com, and any other website, storefront, event page, subscription service, account system, community, mobile or web application, email, SMS, social media feature, affiliate program, contest, awards program, event, show, tour, course, class, downloadable resource, merchandise offering, advertising product, sponsor activation or other service that links to, incorporates or otherwise references these Terms, together with any related features and functionality (collectively, the “BTC Sites”).

BY ACCESSING OR USING THE SERVICES, CREATING AN ACCOUNT, PURCHASING A SUBSCRIPTION, REGISTERING FOR AN EVENT, PURCHASING A TICKET OR MERCHANDISE, JOINING AN AFFILIATE PROGRAM, SUBMITTING CONTENT, OR CLICKING “I AGREE” OR A SIMILAR CHECKBOX, YOU ACCEPT AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICES.
IMPORTANT NOTICE REGARDING ARBITRATION AND CLASS ACTION WAIVER.
SECTION 23 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. PLEASE REVIEW IT CAREFULLY.
1. Eligibility; Professional Audience
The Services are intended primarily for salon owners, licensed cosmetologists, stylists, barbers, colorists, beauty educators, professional beauty brands, distributors, manufacturers, students, and other members of the professional salon and beauty community. You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products, subscriptions, tickets, sponsorships, or other paid Services. If you use the Services on behalf of a business, salon, brand, agency, employer, sponsor, exhibitor, group, or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. Minors may attend certain events only in accordance with the applicable event policies and venue requirements.
2. Additional Terms; Order of Precedence; Separate Agreements
Some Services may be subject to additional terms, rules, policies, order forms, insertion orders, event policies, ticketing terms, sponsor or exhibitor terms, contest rules, affiliate terms, subscription terms, return or refund policies, community guidelines, media releases, or other supplemental terms (collectively, “Additional Terms”). Additional Terms are incorporated into and form part of these Terms. If there is a conflict between these Terms and applicable Additional Terms, the Additional Terms control solely with respect to the specific Service to which they apply, unless they state otherwise.
Without limiting the foregoing, the Event Terms in Exhibit A to these Terms and the Affiliate Program Terms in Exhibit B to these Terms apply to BTC events and affiliate programs, respectively, except to the extent BTC provides different or more specific written terms for a particular event, campaign, promotion, affiliate program or other Service through the applicable registration page, checkout page, event website, affiliate signup page, dashboard, email, text message or other written communication from BTC.
If a user of the Services is also a party to a separate written agreement with BTC that is signed by BTC or otherwise expressly accepted by BTC in writing and that governs a specific business relationship, product, service, sponsorship, advertising program, event participation, content license, employment relationship, contractor engagement or other commercial arrangement (a “Separate Agreement”), then the Separate Agreement shall control solely with respect to the subject matter expressly governed by such Separate Agreement. These Terms shall continue to govern such party’s access to and use of the Services except to the extent a provision of these Terms directly conflicts with a provision of the Separate Agreement relating to the same subject matter, in which case the Separate Agreement shall control with respect to that subject matter only.
3. Accounts; Single Sign-On; Account Security
You may need an account to access certain Services, including BTC University content, paid articles, downloadable resources, event ticketing features, contests, awards submissions, group subscriptions, or community functions. You agree to provide accurate, current, and complete information and to keep it updated. We may use a single sign-on or shared account system across affiliated BTC Sites.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must promptly notify us of any unauthorized access or suspected security breach. We may suspend or terminate accounts that we believe are inaccurate, unauthorized, compromised, abusive, fraudulent, infringing, inactive, or otherwise in violation of these Terms.
You may not sell, transfer, share, sublicense, rent, assign, or otherwise provide your account credentials or subscription access to any third party except as expressly permitted for authorized group subscriptions or gift subscriptions.
4. Privacy; Cookies; Communications
Our Privacy Policy https://behindthechair.com/privacy-policy explains how we collect, use, disclose, and protect personal information in connection with the Services. By using the Services, you acknowledge our Privacy Policy. You may also be asked to manage cookies, analytics, advertising, or similar technologies through our cookie settings or applicable consent tools.
By providing your email address or phone number, you consent to receive transactional messages related to your account, purchases, tickets, subscriptions, events, affiliate activity, security, or the Services. You may also elect to receive marketing communications. You may unsubscribe from marketing emails at any time using the unsubscribe link or other instructions in the message. Transactional, legal, security, and account-related messages may continue notwithstanding marketing opt-outs.
5. Ownership of the Services and BTC Content
The Services and all content, materials, software, data, designs, text, graphics, photographs, images, video, audio, courses, tutorials, formulas, articles, templates, downloadable resources, event materials, logos, trademarks, service marks, trade names, trade dress, page headers, button icons, scripts, look and feel, and other materials made available through the Services (collectively, “BTC Content”) are owned by BTC, its licensors, sponsors, educators, partners, or other content providers and are protected by copyright, trademark, trade secret, publicity, privacy, contract, and other laws.
Subject to your compliance with these Terms and any applicable Additional Terms, BTC grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services and BTC Content solely for your personal, internal, professional education, salon business, or other expressly authorized purposes. No ownership rights are transferred to you.
Except as expressly permitted by BTC in writing, you may not copy, reproduce, distribute, publicly display, publicly perform, sell, resell, license, sublicense, modify, create derivative works from, scrape, download in bulk, archive, train artificial intelligence models on, mirror, frame, republish, upload, post, transmit, exploit, or otherwise use any Services or BTC Content for commercial or public purposes.
6. Professional Education; No Professional, Legal, Tax, Medical or Regulatory Advice
BTC provides education, inspiration, commentary, business resources, creative techniques, trends, templates, and informational content for the professional beauty community. BTC Content is for general educational and informational purposes only and is not a substitute for your own professional judgment, training, licensure, product knowledge, patch testing, safety procedures, manufacturer instructions, legal advice, tax advice, accounting advice, medical advice, or regulatory compliance.
Hair color, cutting, styling, chemical services, extensions, texture services, barbering, business operations, marketing, employment practices, client communications, tax, tips, forms, releases, pricing, AI use, social media, and other subjects may involve legal, health, safety, employment, licensing, manufacturer, or client-specific considerations. You are solely responsible for determining whether and how to use any information, technique, template, or resource in your salon or business and for complying with all laws, regulations, professional standards, insurance requirements, manufacturer instructions, and client obligations that apply to you.
BTC does not guarantee any business result, income level, follower growth, client conversion, salon profitability, technical outcome, color result, career outcome, certification recognition, licensing credit, sponsorship benefit, or other result from any Service.
7. Subscriptions; BTC University; Digital Products
BTC may offer paid subscriptions, memberships, courses, classes, collections, downloadable resources, certificates, group subscriptions, gift subscriptions, and other digital products, including through BTC University. Subscription features, content libraries, pricing, promotional terms, access periods, certificates, and availability may change from time to time.
Unless the applicable checkout page or Additional Terms state otherwise, subscriptions renew automatically for the stated billing period until canceled. You authorize BTC and its payment processors to charge your payment method for recurring subscription fees, applicable taxes, and other amounts due. You are responsible for keeping your payment information current.
You may cancel a subscription as described in your account settings, checkout terms, help center, or applicable Additional Terms. Cancellation generally stops future renewal charges but does not entitle you to a refund for amounts already paid unless required by law or expressly stated in the applicable refund policy. BTC may offer promotional pricing, free trials, coupons, discounts, bundles, or limited-time offers that are subject to additional terms and may not be combined unless expressly permitted.
Digital products, courses, downloads, templates, certificates, video content, and subscription access are licensed, not sold. Except as expressly permitted, you may not share, resell, post, distribute, or use them to create competing products or services.
8. Merchandise; Shop Orders; Returns
Merchandise, physical products, apparel, tools, printed materials, goody bags, and other shop items may be sold through https://shop.behindthechair.com or related storefronts. Product descriptions, pricing, availability, promotions, shipping charges, taxes, delivery estimates, and return eligibility may change without notice. We may limit quantities, reject orders, cancel orders, or refuse service for suspected fraud, resale abuse, pricing errors, inventory errors, or other reasons permitted by law.
Risk of loss and title for physical products pass to you upon delivery to the carrier, except where applicable law provides otherwise. Return and refund rights are governed by the return/refund policy posted for the applicable storefront or otherwise provided at checkout. Returned items must satisfy the posted return requirements. Original shipping charges, return shipping, insurance, restocking fees, and non-returnable items are handled as set forth in the applicable policy.
9. Events; Tickets; Shows; Tours; Awards
BTC produces, hosts, promotes, sponsors, or participates in events, including The BTC Show, BTC “On Tour,” #ONESHOT Hair Awards, education programs, brand activations, parties, workshops, classes, sponsor events, and related experiences. Event attendance, ticket purchases, class registration, venue access, hotel room block access, parties, goody bags, sponsor activations, awards submissions, media capture, and other event benefits are subject to these Terms, the Event Terms in Exhibit A, and any Additional Terms presented at registration or checkout.
Event schedules, educators, artists, speakers, brands, sponsors, classes, workshops, parties, seating, venues, hotels, room blocks, goody bags, benefits, values, and programming are subject to change. BTC does not guarantee any particular educator, sponsor, class, seat, sample, product, benefit, result, or experience unless expressly stated in binding Additional Terms.
10. Brands; Sponsors; Advertising; Third-Party Offers
The Services may include sponsor content, advertisements, brand partnership opportunities, sponsored education, product launches, product samples, goody bags, affiliate links, discount codes, brand booths, Connection Center activations, and other commercial content. Unless expressly stated, BTC does not manufacture, sell, warrant, endorse, or assume responsibility for third-party products or services. Any claims, instructions, warranties, ingredients, safety information, promotions, samples, offers, or product performance representations are the responsibility of the applicable third party.
Brand partners, sponsors, advertisers, manufacturers, agencies, and other business customers are responsible for ensuring that their materials, claims, products, promotions, giveaways, sweepstakes, influencer campaigns, disclosures, and uses of the Services comply with applicable laws, platform rules, industry standards, FTC endorsement guidance, advertising laws, and contractual obligations.
11. User Content
The Services may allow you to submit, post, upload, transmit, tag, display, publish, share, enter, nominate, register, stream, distribute or otherwise provide photos, videos, before-and-after images, competition entries, awards submissions, hair designs, technical work, demonstrations, formulas, educational content, articles, comments, reviews, ratings, testimonials, social media content, social media handles, profile information, questions, messages, feedback, ideas, downloads, documents, business information, salon information, brand materials and other content or materials (collectively, “User Content”).
You retain ownership of your User Content, subject to the licenses granted in these Terms and any applicable Additional Terms. By submitting User Content, you grant BTC and its affiliates, successors, licensees, sublicensees, service providers, sponsors, partners and designees a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, royalty-free, fully paid license to use, reproduce, distribute, display, perform, publish, transmit, modify, adapt, edit, translate, create derivative works from, commercialize and otherwise exploit your User Content, including any photos, videos, before-and-after images, competition entries, awards submissions, hair designs, technical work, demonstrations and related materials, in whole or in part, in any media or format now known or later developed, for purposes of operating, improving, promoting, marketing, advertising, covering, documenting and monetizing the Services, BTC, the BTC Sites, BTC events, BTC programs, sponsor activations, awards, editorial coverage, social channels and related business activities.
You represent and warrant that: (a) you own or have all rights, licenses, permissions, releases, consents, and clearances necessary to submit the User Content and grant the above license; (b) the User Content and BTC’s use of it do not and will not infringe, misappropriate, or violate any intellectual property, privacy, publicity, contract, employment, confidentiality, moral, consumer protection, advertising, or other rights; (c) you have obtained valid releases from all persons appearing in or contributing to the User Content, including clients, models, minors, employees, contractors, photographers, videographers, educators, and brands, as applicable; and (d) the User Content is accurate, not misleading, and complies with all applicable laws and these Terms.
BTC may, but has no obligation to, monitor, remove, edit, disable, restrict, or refuse any User Content for any reason, including if we believe it violates these Terms, applicable law, third-party rights, platform rules, or BTC standards.
12. Reviews, Testimonials, Before and After Photos, and Results Claims
If you submit reviews, ratings, testimonials, success stories, before/after images, business results, income claims, follower growth claims, technical results, or similar content, you must be truthful, must disclose any material connection with BTC, a sponsor, brand, educator, or product, and must not make deceptive, unsubstantiated, or misleading claims. BTC may use submitted testimonials and reviews for promotional purposes, subject to applicable law.
13. Community Standards and Prohibited Conduct
You agree not to use the Services to: (a) violate any law, regulation, court order, contract, or third-party right; (b) infringe intellectual property, privacy, publicity, or confidentiality rights; (c) harass, threaten, abuse, defame, impersonate, discriminate against, exploit, or harm any person; (d) post obscene, pornographic, hateful, violent, misleading, fraudulent, or otherwise objectionable content; (e) transmit viruses, malware, spyware, worms, or harmful code; (f) scrape, crawl, index, harvest, mine, or extract data except as permitted by robots.txt and applicable law; (g) use the Services or BTC Content to train, fine-tune, prompt, benchmark, validate, or develop artificial intelligence or machine learning systems without BTC’s written consent; (h) bypass paywalls, access controls, security measures, geoblocking, ticketing controls, subscription limits, or digital rights management; (i) reverse engineer or interfere with the Services; (j) resell tickets, subscriptions, downloads, courses, or access except as expressly authorized; (k) use bots, scripts, fake accounts, automated purchasing, credential stuffing, coupon abuse, affiliate fraud, or similar conduct; (l) misrepresent your identity, credentials, licensure, business, affiliation, sponsorship, brand relationship, or endorsement; or (m) interfere with the safety, integrity, operation, reputation, or enjoyment of the Services.
14. Contests, Awards, Promotions and Giveaways
Contests, sweepstakes, awards programs, giveaways, promotions, and similar programs are subject to their official rules or Additional Terms. If you participate, you agree to comply with those rules and all eligibility, submission, judging, voting, prize, tax, release, publicity, and conduct requirements. BTC may disqualify entries or participants that we believe violate applicable rules, these Terms, law, third-party rights, or fair play standards.
15. Affiliate, Ambassador, Referral and Discount Programs
BTC may operate affiliate, ambassador, referral, discount code, influencer, or promotional programs. Participation is by approval only and subject to the Affiliate Program Terms in Exhibit B and any program-specific terms. BTC may approve, reject, suspend, terminate, reverse commissions, modify codes, change commission rates, or end any program in its discretion, subject to applicable law and any binding written agreement.
16. Payment Terms; Taxes; Errors
Prices are stated in U.S. dollars unless otherwise indicated. You agree to pay all charges, fees, taxes, shipping, handling, service fees, processing fees, duties, and other amounts incurred in connection with your purchases. BTC may use third-party payment processors, ticketing providers, subscription platforms, ecommerce platforms, and buy-now-pay-later providers. Your use of those services may be subject to additional third-party terms.
BTC may correct pricing, typographical, inventory, programming, package, value, benefit, coupon, ticketing, or other errors at any time. If an error affects your order, BTC may cancel the order, refund amounts paid, or provide another lawful remedy. Coupons, discount codes, affiliate codes, credits, promotional offers, gift subscriptions, and other incentives are subject to stated restrictions and may not be combined, transferred, sold, applied retroactively, or redeemed for cash unless expressly permitted.
17. Third-Party Platforms and Links
The Services may link to or integrate with third-party websites, platforms, social networks, payment processors, ticketing platforms, ecommerce providers, shipping carriers, video players, analytics providers, advertising networks, hotel booking systems, map providers, login providers, and other services. BTC does not control and is not responsible for third-party services, content, policies, terms, products, availability, security, or practices. Your dealings with third parties are solely between you and the applicable third party.
18. Intellectual Property Complaints; DMCA
BTC respects intellectual property rights. If you believe content on the Services infringes your copyright, please send a notice compliant with the Digital Millennium Copyright Act to: Behindthechair.com, Inc., Attn: Copyright Agent, 1900 S Highland Ave, Suite 103, Lombard, IL 60148; Email: privacy@behindthechair.com. Your notice should include the information required by 17 U.S.C. § 512(c)(3).
BTC may remove allegedly infringing content and terminate repeat infringers in appropriate circumstances. If you believe your content was removed by mistake, you may submit a counter-notification as permitted by law.
19. Suspension; Termination
BTC may suspend, restrict, or terminate your access to the Services, accounts, tickets, subscriptions, programs, affiliate participation, or purchases, with or without notice, if BTC believes you violated these Terms, applicable Additional Terms, law, venue rules, payment obligations, third-party rights, or BTC’s safety, integrity, fraud prevention, reputation, or business interests. Upon termination, your rights to access the Services and BTC Content cease immediately. Sections that by their nature should survive termination will survive, including ownership, license, User Content, payments, disclaimers, limitations, indemnity, dispute resolution, and general provisions.
20. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, BTC CONTENT, EVENTS, TICKETS, SUBSCRIPTIONS, DIGITAL PRODUCTS, DOWNLOADS, TEMPLATES, MERCHANDISE, USER CONTENT, SPONSOR CONTENT, AND THIRD-PARTY MATERIALS ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. BTC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, SECURITY, AND COURSE OF DEALING.
BTC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, CURRENT, COMPLETE, ACCURATE, AVAILABLE IN ANY PARTICULAR LOCATION, FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED. BTC DOES NOT WARRANT ANY PROFESSIONAL, EDUCATIONAL, BUSINESS, TECHNICAL, CREATIVE, FINANCIAL, SOCIAL MEDIA, LICENSING, TAX, LEGAL, HEALTH, SAFETY, OR OTHER RESULT.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BTC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, EDUCATORS, SPONSORS, PARTNERS, LICENSORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST GOODWILL, BUSINESS INTERRUPTION, SUBSTITUTE SERVICES, PERSONAL OR PROFESSIONAL INJURY, CLIENT CLAIMS, PRODUCT CLAIMS, OR LOSS ARISING FROM OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BTC’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO BTC FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) $100. THE FOREGOING LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, STATUTE, OR OTHERWISE.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the limitations apply to the maximum extent permitted by law.
22. Indemnification
You agree to defend, indemnify, and hold harmless BTC and its affiliates, officers, directors, employees, contractors, educators, sponsors, partners, licensors, service providers, and agents from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to: (a) your access to or use of the Services; (b) your User Content; (c) your breach of these Terms or any Additional Terms; (d) your violation of law or third-party rights; (e) your products, services, salon activities, professional services, client relationships, employment practices, advertising claims, sponsorship materials, or promotions; (f) your attendance at or conduct during any event; (g) your affiliate, ambassador, referral, or promotional activity; or (h) any fraud, negligence, willful misconduct, or misuse of the Services by you or anyone using your account.
23. Binding Arbitration; Class Action Waiver
Except for the exceptions below, you and BTC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, any purchase, subscription, ticket, event, User Content, affiliate program, privacy or data incident, or any relationship between you and BTC (a “Dispute”) will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules or Commercial Arbitration Rules, as applicable, except as modified by these Terms. The arbitration will be conducted by a single arbitrator in Chicago, Illinois, unless the arbitrator determines that another location, video conference, telephone, or documents-only procedure is required by applicable rules or law.
You and BTC waive the right to a jury trial. You and BTC agree that each may bring claims only in an individual capacity and not as a plaintiff, class member, private attorney general, or representative in any class, collective, consolidated, mass, or representative action. The arbitrator may not consolidate claims or preside over any class, collective, consolidated, mass, or representative proceeding, except to the extent this waiver is found unenforceable under applicable law.
This arbitration agreement does not prevent either party from seeking relief in small claims court, seeking temporary or preliminary injunctive relief in aid of arbitration, or bringing claims for intellectual property infringement, misappropriation, unauthorized access, or misuse of the Services in a court of competent jurisdiction. You may opt out of this arbitration agreement within 30 days after first accepting these Terms by sending written notice to privacy@behindthechair.com with your name, address, email, and a clear statement that you opt out of arbitration.
24. Governing Law; Venue
These Terms and any Dispute are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the interpretation and enforcement of Section 23. For any Dispute not subject to arbitration, you and BTC irrevocably submit to the exclusive jurisdiction and venue of the state and federal courts located in Cook County, Illinois, and waive any objection to jurisdiction, venue, or inconvenient forum.
25. International Users
BTC is based in the United States. If you access the Services from outside the United States, you are responsible for compliance with local laws. BTC makes no representation that the Services are appropriate or available in all jurisdictions. Access to certain Services, events, products, subscriptions, contests, promotions, or content may be limited, unavailable, or subject to additional requirements in certain jurisdictions.
26. Changes to the Services and Terms
BTC may modify, suspend, discontinue, or replace all or any part of the Services at any time. BTC may update these Terms from time to time. The updated Terms will be posted with a revised “Last Updated” date. Unless otherwise stated, updated Terms are effective when posted. Your continued use of the Services after updated Terms are posted constitutes acceptance of the updated Terms.
27. General Provisions
These Terms, together with the Privacy Policy and applicable Additional Terms, constitute the entire agreement between you and BTC regarding the Services and supersede prior or contemporaneous understandings regarding the Services. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect. BTC’s failure to enforce any provision is not a waiver. You may not assign these Terms without BTC’s prior written consent. BTC may assign these Terms in connection with a merger, acquisition, sale of assets, corporate reorganization, change of control, or by operation of law. Headings are for convenience only. The word “including” means “including without limitation.”

Event Terms
These Event Terms apply to all BTC events, shows, tours, classes, workshops, parties, awards programs, sponsor activations, ticketed experiences, and event-related services, including The BTC Show, BTC “On Tour,” and #ONESHOT Hair Awards.
These Event Terms may be supplemented, modified or replaced for a particular event by the event-specific terms, policies, FAQs, registration materials, checkout terms, emails, text messages or other written communications provided by BTC for that event.
1. Tickets and Registration
Tickets, badges, credentials, classes, workshops, seating, packages, parties, goody bags, hotel room block access, sponsor activations, and other benefits are subject to availability, capacity, venue rules, package level, eligibility, and any Additional Terms presented at purchase or registration. BTC may deny or revoke access for fraud, abuse, resale, safety concerns, violation of these Terms, or nonpayment.
2. Changes; No Guaranteed Participants
BTC may change dates, times, schedules, venues, hotels, room blocks, educators, artists, speakers, sponsors, brands, classes, workshops, parties, seating, package benefits, goody bags, and programming. Educator, sponsor, artist, or brand substitutions, cancellations, or schedule changes do not entitle you to a refund unless required by law or expressly stated in the applicable refund policy.
3. Refunds; Transfers; Cancellations
Refund, cancellation, transfer, substitution, upgrade, downgrade, and credit rights are governed by the applicable event policy and checkout terms. Unless expressly permitted by BTC, tickets, badges, credentials, hotel links, class registrations, and package benefits may not be resold, transferred, bartered, auctioned, or used for commercial promotions.
4. Event Conduct and Safety
You must comply with all venue, security, health, safety, hotel, alcohol, badge, seating, class, party, sponsor, and staff instructions. BTC may remove any attendee whose conduct is disruptive, unsafe, harassing, discriminatory, unlawful, intoxicated, threatening, fraudulent, infringing, or inconsistent with the professional and inclusive nature of the event.
5. Photography, Recording and Media Release
By attending, participating in, speaking at, exhibiting at, sponsoring, competing in, judging, volunteering at, submitting content to, or otherwise participating in a BTC event, you acknowledge and agree that BTC, its affiliates, sponsors, exhibitors, educators, vendors, media partners, licensees, designees and service providers may photograph, film, livestream, webcast, record and otherwise capture your name, image, likeness, voice, appearance, biographical information, social media handles, statements, submissions, competition entries, awards submissions, demonstrations, technical work, hair designs, before-and-after images, performances and participation (collectively, “Event Media”).
You irrevocably grant BTC and its designees a perpetual, worldwide, royalty-free, fully paid, transferable and sublicensable right and license to record, use, reproduce, publish, distribute, display, perform, edit, modify, create derivative works from, transmit, exploit and otherwise use Event Media, in whole or in part, in any format or media now known or later developed, for editorial, educational, promotional, advertising, marketing, sponsorship, publicity, archival, commercial and other lawful purposes, without notice, compensation or further approval.
You waive any right to inspect, approve or receive compensation for any use of Event Media and, to the maximum extent permitted by law, release BTC and its designees from claims relating to rights of publicity, privacy, likeness, defamation, false endorsement or similar claims arising from the authorized use of Event Media.
6. Minors and Third Parties
If you register, purchase tickets for, bring, supervise, accompany or otherwise attend a BTC event with a minor or other individual for whom you are legally authorized to act, you represent and warrant that you have authority to consent to the collection and use of such person’s name, image, likeness and voice as contemplated by these Terms and grant the foregoing rights on such person’s behalf.
7. Attendee Recording Restrictions
Personal photography and short social media clips may be permitted unless prohibited by BTC, educators, sponsors, venues, or posted rules. Professional recording, livestreaming, rebroadcasting, commercial photography, class recording, backstage capture, credential misuse, or capture of proprietary techniques or paid content is prohibited without BTC’s written consent. Without limiting the foregoing, you acknowledge that attendance at events may involve exposure to communicable diseases, illnesses, viruses, bacteria or other pathogens and voluntarily assume all risks associated therewith to the maximum extent permitted by law.
8. Assumption of Risk
Event attendance involves risks, including travel, crowds, lighting, sound, alcohol service, demonstrations, chemicals, tools, beauty products, samples, illness, personal injury, property loss, and conduct of other attendees or third parties. To the maximum extent permitted by law, you voluntarily assume all risks associated with attending or participating in events.
9. Sponsors, Samples and Goody Bags
Sponsor products, samples, goody bags, discounts, demonstrations, and claims are provided by third parties. BTC is not responsible for product defects, allergic reactions, ingredients, instructions, warranties, recalls, or claims made by sponsors or manufacturers. Goody bag values and contents are estimates and may vary.
10. Hotel and Travel
Hotel room blocks, booking links, rates, minimum stays, availability, taxes, resort fees, deposits, cancellations, and room policies are controlled by the applicable hotel or booking provider. BTC is not responsible for travel, lodging, transportation, or other expenses, including if an event changes or is canceled, except as expressly stated in binding Additional Terms.
11. Awards and Submissions
Awards programs and contests are subject to official rules. BTC may use submissions, finalist materials, names, images, social handles, and related content for awards, editorial, promotional, advertising, and archival purposes as provided in the applicable rules and these Terms.

Affiliate Program Terms
These Affiliate Program Terms apply to any BTC affiliate, ambassador, referral, influencer, discount code, ticket promotion, or similar program unless a separate signed agreement or more specific written program terms provided by BTC state otherwise. Program details, including eligible products or tickets, discount amounts, commission rates, payout timing, promotional periods, attribution rules and other campaign-specific requirements, may be set forth on the applicable signup page, dashboard, event website, checkout page, email, text message, campaign materials or other written communication from BTC.
1. Program Appointment
BTC may approve selected participants to promote eligible BTC products, tickets, subscriptions, events, or other offerings using a unique link, code, tracking mechanism, or other credential. Participation is not exclusive and does not create an employment, agency, franchise, joint venture, partnership, fiduciary, or representative relationship.
2. Current and Future Affiliate Programs
BTC may, from time to time, offer affiliate, ambassador, referral, influencer, ticket promotion, event promotion, or similar marketing programs (each, an “Affiliate Program”). The specific terms applicable to a particular Affiliate Program, including eligibility requirements, approved promotional methods, applicable products, services, subscriptions, events, ticket packages, discount amounts, commission rates, qualification criteria, payout schedules, promotional periods, geographic restrictions, and other campaign-specific requirements (collectively, the “Program Terms”), may be communicated through the applicable registration page, affiliate portal, dashboard, event website, order page, email, text message, written notice, or other communication from BTC.
The Program Terms are incorporated into and form part of these Terms. In the event of any conflict between these Terms and any Program Terms, the Program Terms shall control solely with respect to the applicable Affiliate Program.
Unless otherwise expressly stated in the applicable Program Terms, discounts may not be combined with other offers, commissions are earned only on qualifying transactions that are properly tracked by BTC, fully paid, not refunded, not canceled, not disputed, and not subject to chargeback, and BTC reserves the right to modify, suspend, terminate, or replace any Affiliate Program or Program Terms at any time in its sole discretion.
BTC’s tracking, attribution, qualification, and commission determinations shall be final and binding absent manifest error.
3. Qualifying Sales; Tracking
Commissions are earned only on qualifying sales that BTC can verify through its systems. BTC is not responsible for tracking failures caused by user error, blocked cookies, browser settings, ad blockers, expired sessions, code misuse, platform limitations, refunds, chargebacks, fraud, or third-party systems. BTC’s records are controlling absent manifest error.
4. Commission Payment
BTC will pay approved commissions on the schedule and through the payment method designated by BTC, subject to identity verification, tax documentation, fraud review, minimum payout thresholds, refund windows, chargeback periods, and other compliance checks. BTC may withhold, offset, reverse, or claw back commissions for refunded, canceled, fraudulent, self-referred, duplicate, noncompliant, or improperly attributed transactions.
5. FTC and Advertising Disclosures
Affiliates must clearly and conspicuously disclose their material connection to BTC in all promotional content, including social media posts, stories, videos, emails, texts, websites, and other communications. Disclosures must be understandable, unavoidable, and placed with the endorsement or promotion. Examples may include “I earn a commission from BTC purchases made with my code” or “#BTCPartner,” if accurate and sufficiently clear in context.
6. Promotional Restrictions
Affiliates may not: (a) make false, misleading, unsubstantiated, or deceptive claims; (b) imply that BTC, an educator, sponsor, artist, or brand endorses them unless expressly authorized; (c) use paid search, keyword bidding, domain names, handles, ads, or SEO practices using BTC marks without written approval; (d) use spam, unsolicited messages, bots, fake accounts, coupon scraping sites, browser extensions, or malware; (e) purchase tickets through their own link or code to generate commissions unless BTC expressly permits self-referrals; (f) offer cash rebates, kickbacks, code stacking, unauthorized incentives, or misleading discounts; (g) alter BTC creative assets except as permitted; (h) promote to audiences primarily consisting of minors; or (i) violate platform rules, law, these Terms, or BTC brand standards.
7. BTC Marks and Creative Assets
BTC grants approved affiliates a limited, revocable, non-exclusive, non-transferable license to use BTC-provided links, codes, graphics, and approved promotional materials solely to promote the applicable program during the program term. Affiliates must comply with BTC brand guidelines and immediately stop using BTC marks upon request or termination.
8. Taxes; Independent Contractor
Affiliates are independent contractors and are solely responsible for all taxes, forms, reporting, expenses, insurance, licenses, and compliance obligations relating to commissions or promotional activity. BTC may require a completed Form W-9, Form W-8, or other tax documentation before payment.
9. Termination; Program Changes
BTC may reject applications, change eligible products, discounts, commission rates, payout timing, tracking methods, program rules, or program duration, or suspend or terminate any affiliate or program at any time. Upon termination, the affiliate must stop using all codes, links, BTC marks, and promotional materials. Accrued commissions remain subject to verification, reversals, offsets, and compliance review.
10. Compliance Indemnity
Affiliates will indemnify BTC for claims, losses, fines, penalties, fees, investigations, chargebacks, platform actions, or damages arising from the affiliate’s promotional activity, disclosures, content, breach of these Terms, law violations, or misuse of BTC marks, links, codes, or materials.

#ONESHOT Hair Awards Contest: Terms and Conditions, Releases and Representations
By submitting images in connection with the #ONESHOT Hair Awards Contest, you are agreeing to the terms and conditions described here and that you agree to be bound by those terms as if you entered into a written agreement with BEHINDTHECHAIR.COM, INC. (“BTC”). This sign-up is for US consumers only. By submitting pictures to us in connection with the #ONESHOT Contest you “Stylist” represent and warrant to BEHINDTHECHAIR.COM, INC. “BTC” that all photographic images submitted in connection with the Contest (the “Entry”) constitute original copyrighted works of the Stylist and that the Stylist is free to grant, and does hereby grant BTC a non-exclusive, royalty-free, fully paid, perpetual, right and license to reproduce, distribute, display, and create derivative works of the Entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. If the photograph contains any material or elements that are not owned by the stylist and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the stylist is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these Official Rules without any compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release. Stylist shall indemnify and hold BTC (and its officers, directors, shareholders and affiliates, the “Indemnified Parties”) harmless from any losses incurred by the Indemnified Parties as a result of a breach by Stylist of the representations and warranties made in this agreement. Upon BTC’s request, each stylist must be prepared to provide (within five (5) calendar days of receipt of BTC’s request) a signed release from all persons who appear in the photograph submitted, and/or from the owner of any material that appears in the photograph entry, authorizing BTC to reproduce, distribute, display, and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. Failure to provide such releases upon request may result in disqualification at any time during the Contest and selection of an alternate winner.
Stylist further represents and warrants that all submitted images are photographs of real hair work performed by the Stylist, captured on a physical camera or device, and have not been generated or materially altered by artificial intelligence tools of any kind. Prohibited AI usage includes but is not limited to: AI image generators (such as Midjourney, DALL-E, Stable Diffusion, or Adobe Firefly), AI-powered inpainting, outpainting, style transfer, or reconstruction of any portion of the image. Basic photo editing is permitted (exposure, contrast, color grading, cropping, blemish removal, and non-AI skin retouching) provided such edits do not alter the hair’s style, shape, or color. Upon BTC’s request, Stylist must provide the original unedited image file within five (5) calendar days. Failure to provide the original file, or any determination by BTC that an entry was AI-generated or AI-manipulated, will result in immediate disqualification and may result in a permanent ban from future #ONESHOT Hair Awards participation. Disqualification may occur at any stage, including after a winner has been announced, and BTC reserves the right to revoke any title, prize, or recognition awarded. Stylist shall indemnify and hold the Indemnified Parties harmless from any losses arising from a breach of this representation.
For the purposes of these Terms and Conditions, the entrant will be deemed to be in receipt of BTC’s request or notification, (a) in the event that BTC sends the request by postal mail, five business days after the request was sent by BTC, or (b) in the event that BTC sends the request by email or other electronic means including a message on Instagram, on the day that the email or electronic transmission or posting was sent or posted by BTC.

Photography & Media Release (Event Registration)
1. Consent to Photography, Filming, and Recording
I understand that Behindthechair.com and its affiliates may photograph, film, or otherwise record event activities at any BTC-hosted event I attend, now or in the future. I hereby grant full permission to Behindthechair.com, its event partners, sponsors, agents, and media affiliates (collectively, “BTC Parties”) to capture, record, and use my image, voice, and likeness, and that of any minor(s) attending with me, in any form of media now known or developed in the future.
2. Use of Media for Promotional Purposes
I consent to the use of such recordings for any lawful purpose, including but not limited to marketing, advertising, digital and print promotion, social media, website content, sponsorship outreach, and the marketing of future BTC events, in any geographic location, in perpetuity, and without financial compensation.
3. Commercial Release
I understand and agree that such media may be used commercially and may feature me and/or any minor(s) attending with me individually or as part of a group. I waive any right to inspect or approve the final images or recordings and release the BTC Parties from any liability arising from their use, including rights of privacy, publicity, or likeness.
4. Parental/Guardian Consent for Minors
If I bring a minor under the age of 18 to the event, I affirm that I am their parent or legal guardian and have the authority to provide this release on their behalf. I provide full consent for BTC Parties to record and use the minor’s image and likeness on the same terms described above.
Refund Policy: BTC Events
There are no refunds or exchanges. By entering my payment information and completing the purchase, I hereby agree to pay the total specified. You understand that by attending BTC On Tour, you are agreeing to assume all risks hazards and dangers arising from or relating in any way to the risk of contracting a communicable disease or illness—including without limitation exposure to COVID-19 or any other bacteria virus or other pathogen capable of causing a communicable disease or illness, whether that exposure occurs before during or after BTC On Tour and regardless of how caused or contracted.
